Federal Judge Orders Freedom of Abrego Garcia from Immigration Detention

Courtroom scene

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was detained in immigration detention.

In her decision, the judge noted that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal proceedings center on conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in Tennessee.

Terms of Freedom

The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.

This ruling marks a significant development in a complex immigration battle involving allegations of wrongful detention and disputed criminal affiliations.
