Alina Habba has stepped down as New Jersey's top federal prosecutor. This decision was prompted by a court battle that challenged her legal standing to serve.

Attorney General's Statement

US Attorney General, Pam Bondi, announced Habba's resignation on the start of the week. Bondi stated that the court's "flawed" ruling made it impossible for Habba to effectively run her office.

"But do not mistake compliance for surrender," she declared. "This battle will now stretch across America."

Legal Background

Her resignation comes a week after a judicial panel ruled that she had been serving in violation of the law as the top prosecutor. This decision is likely to affect many prosecutions in New Jersey.

The court declared that a acting appointment that bypassed confirmation by the US Senate ran afoul of the statute on vacant positions.

Next Steps and Responses

Bondi said that Habba will remain at the justice department as a top consultant. Habba plans to pursue additional appeals of the ruling, aiming for a reversal.

Writing online, the Attorney General wrote that judges "must not countermand the President's choice of prosecutors tasked with performing the fundamental role of the presidency of enforcing the law."

Performance in Office

The attorney general praised the prosecutor's work and said that under her leadership, the state capital of Newark saw a significant drop in crime. It was also reported that the Camden had its first summer in half a century with no murders.

Background and Previous Role

Habba, originally became part of Trump's personal legal team in recent years. Subsequently, she acted for Trump in his business records case in 2024, when he was conviction on 34 counts of falsifying business records.

Prior to Habba took on the top New Jersey post, Trump had stated he was appointing her as his presidential counsellor in a potential future term, describing her as deeply loyal and a "tireless advocate for justice".
